GENERAL TERMS AND CONDITIONS OF SALE
You have just connected to the MOROCCAN TUNIC website of CRUZ AND CO. You must read the following provisions carefully as they constitute a contract establishing the general conditions of the products and services in the CRUZ AND CO catalogue.
The "click" that you make after completing your order form constitutes validation of your order and irrevocable acceptance of these terms and conditions. Consequently, you can only order products or services if you accept the conditions set out below.

1. Preambule
The following general terms and conditions of sale govern all transactions established on the CRUZ AND CO web catalogue. Any order placed on this site implies the customer's unconditional and irrevocable acceptance of these conditions.
2. Purpose
This contract is a distance contract whose purpose is to define the rights and obligations of the parties in connection with the sale of CRUZ AND CO products on the Internet, via the secure online payment platform of the Centre Monétique Interbancaire.
MOROCCAN TUNIC is a service and trademark registered by CRUZ AND CO.
3. Definitions
In the rest of the contract, each of the expressions mentioned above will be understood in the sense of its definition, i.e. :
- "Distance contract": any contract for goods or services between the Company CRUZ AND CO and a Consumer under a distance sales or service provision system organised by the Company CRUZ AND CO which, for this contract, exclusively uses the Internet network until the conclusion of the contract, including the conclusion of the contract itself.
- "Consumer": any natural person who, in this contract, is acting for purposes that are not part of their professional activity.
- "Order Form": document indicating the characteristics of the Products ordered by the Consumer, which must be signed by the Consumer by "double-clicking" in order to be binding.
- "Order": act by which the Consumer undertakes to purchase Products and CRUZ AND CO to deliver them.
4. Product
All products in the catalogue are sold while stocks last.
CRUZ AND CO reserves the right to withdraw an item from the catalogue without prior notice. CRUZ AND CO cannot under any circumstances be required to compensate or cancel an order following the impossibility of using the product purchased due to incompatibility with equipment already owned by the purchaser.
5. Placing an order
Once you have found the product(s) you are interested in, click on the "order" button, and the product will be added to your order form.
You can modify your order form at any time and return to the catalogue by clicking on "Continue shopping".
When you have finished shopping, confirm your order by clicking on the "Pay" button.
6. Price
The prices given in the catalogue are inclusive of tax
7. Order processing
The order will be executed at the latest within 48 hours of the day following the day which the Consumer placed the order.
If the Product ordered is unavailable, the Consumer will be informed as soon as possible and will have the option of cancelling the order.
The Consumer will then have the choice of requesting either a refund of the sums paid within thirty days of their payment, or an exchange of the Product.
8. Delivery
All deliveries are made by DHL.
The Products are delivered to the address indicated by the Consumer on the Order Form. The Consumer must check the goods on delivery and report any damage to the carrier on the delivery slip and to CRUZ AND CO within one day.
At the Consumer's request, an invoice can be sent to the delivery address by validating the option provided for this purpose on the Order Form.
How much does delivery cost?
Delivery is free for all orders over €200.
What are the delivery times?
Once we have received your payment, your order will be dispatched within 48 hours, subject to stock availability.
Normal delivery times are 5 to 7 working days, but can be as long as 10 to 12 days during periods of high demand.
Any delays do not give rise to compensation, cancellation of the order or refusal to accept delivery.
Customs or import duties may be added to the price of our products and are payable by the customer. It is the customer's responsibility to find out the amount of these taxes from their local customs office.
9. Method of payment
To pay for your order, you choose the method of payment from among those proposed by CRUZ AND CO on the payment page.
In this case, the transaction will be debited from your account on the day following the date of confirmation of delivery.
Your online payments are secured by the Centre Monétique Interbancaire (CMI) which offers a fully secure payment service.
The Consumer guarantees CRUZ AND CO that he/she has the necessary authorisations to use the method of payment chosen by him/her when validating the Order Form.
In the event of payment by bank card, the provisions relating to fraudulent use of the means of payment set out in the agreements concluded between the Consumer and the card issuer and between CRUZ AND CO and its banking institution apply.
10. Data confidentiality
The information you are asked to provide is necessary to process your order and will be treated as confidential.
You have the right to rectify your personal data.
11. Right of retractation
From the date of delivery of your order, you have 7 days to exercise your right of withdrawal and receive a full refund. You are responsible for the cost of returning the goods, which are sent by post with a tracking number. However, only items returned in perfect condition for resale, complete and in their original packaging (unopened) may be refunded.
Items purchased during online sales cannot be returned.
12. Warranty
All products sold in the catalogue are guaranteed against manufacturing and material defects. The duration of this guarantee is at least one year (from the invoice date). In the event of the return of non-defective equipment, the customer may be billed for transport and handling costs. This guarantee does not cover damage resulting from accidents, misuse or negligence.
13. Proof of transactions paid for by bank card
The data recorded by the IEPC on the online payment platform on behalf of CRUZ AND CO constitutes proof of the commercial transactions between you and CRUZ AND CO.
14. Major force
CRUZ AND CO is only responsible for the performance of its obligations insofar as they are not hindered by an event of major force.
15. Applicable law
The customer accepts and fully acknowledges that Moroccan law governs these general conditions of sale, as well as any dispute that may arise between the customer and CRUZ AND CO. Moroccan law and its courts shall have sole jurisdiction to settle the dispute.
